In consideration of being permitted to participate in the Benicia Yacht Club Beer Can and associated races, for myself and my heirs, next of kin, legal representatives, successors, and assigns, and in consideration of acceptance to participate in such races:

(a) I acknowledge that a sailing race has inherent risks and dangers and hereby assume those risks and dangers. These risks include but are not limited to personal injury and death and damage to and or loss of equipment and the sailing vessel itself through some failure of the vessel, collision with other vessels, debris, or animals as well as loss due to adverse weather conditions and seas.

(b) I waive and release to the fullest extent permitted by law any and all claims that I may have or that may arise against Benicia Yacht Club and any other host club, their officers, directors, members, committee members, volunteers, employees, advisors, and agents or any one or more of them, or their executors, administrators, heirs, next of kin, successors or assigns, including any and all claims for damages caused by the active or passive negligence of any of them arising out of my participation in the race or its related activities.

(c) I further expressly agree the foregoing release and waiver is intended to be as broad and inclusive as is permitted by law and that if any portion, clause or sub-clause hereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full force and effect. I have carefully read this agreement and fully understand its contents. I am aware that this is a release of liability and waiver of claims and sign it of my free will.

(d) I grant permission to Benicia Yacht Club and its designees to release or report information about my participation in the race and to use for any purpose any photograph or video of me or my yacht taken or submitted in connection with the race and its activities.

(e) This waiver shall apply to the 2023 Beer Can Series and, unless revoked in writing by me, to all future races organized by Benicia Yacht Club which I may enter.
